DMCA Policy
How to submit copyright infringement notices and counter notices.

SmilePlease respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and similar laws.

Filing a DMCA takedown notice
If you believe content on SmilePlease infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:
- Identification of the copyrighted work: Describe the copyrighted work you claim has been infringed. If multiple works are covered, provide a representative list.
- Identification of the infringing material: Identify the material you claim is infringing and provide information reasonably sufficient to locate it (e.g., URLs or descriptions).
- Your contact information: Include your name, address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- Signature: A physical or electronic signature of the copyright owner or authorized representative.

What happens after we receive a notice
- Review: We will review the notice for completeness and validity.
- Action: If the notice is valid, we will promptly remove or disable access to the allegedly infringing content.
- Notification: We will notify the user who posted the content that it has been removed.
- Timeline: We aim to process valid notices within 24-48 hours.
Filing a counter notice
If you believe your content was removed by mistake or misidentification, you may file a counter notice. Your counter notice must include:
- Identification of removed material: Identify the material that was removed and its location before removal.
- Your contact information: Your name, address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any judicial district where SmilePlease may be found) and that you will accept service of process from the complainant.
- Good faith statement: A statement, under penalty of perjury, that you have a good faith belief the material was removed by mistake or misidentification.
- Signature: Your physical or electronic signature.

Counter notice process
- We will forward your counter notice to the original complainant.
- If the complainant does not file a court action within 10-14 business days, we may restore the removed content.
- We will notify you of the outcome.
Repeat infringer policy
We maintain a policy to terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We may also limit access to the service and/or terminate accounts of users who infringe intellectual property rights, regardless of whether there is repeat infringement.
False claims warning
Filing a false DMCA notice or counter notice may result in legal liability. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
We recommend consulting with a legal professional before submitting a DMCA notice or counter notice.
Fair use
Before submitting a DMCA notice, please consider whether the use of the material may qualify as "fair use" under copyright law. Fair use permits limited use of copyrighted material without permission for purposes such as criticism, commentary, news reporting, teaching, scholarship, or research.
